BREAKING🚨 A federal appeals court just ruled there is NO constitutional right to CLEAN drinking water — and no right to be told the truth by officials during a public health crisis. The full Fifth Circuit handed down the decision Friday in New Orleans, ending a lawsuit brought by four Jackson, Mississippi residents. Priscilla Sterling, Raine Becker, Shawn Miller and John Bennett said the city let lead leach into their drinking water and then told them it was safe to drink. State health department testing from 2010 to 2013 showed lead in Jackson's water increasing "at an alarming rate." The residents say the city ignored the warnings and switched part of Jackson from a safe groundwater source to corrosive surface water that was already pulling lead out of the pipes. Court records state several of Sterling's children have been diagnosed with lead poisoning, and that two other households are showing effects of lead poisoning or other contamination. Judge Kurt Engelhardt, writing for the majority, called the loss of clean water and honest information "grievous" and said it did "not infringe upon any deeply rooted constitutional right." "We are skeptical that the right to not be harmed by lead-contaminated water fits within the right to bodily integrity," he wrote. He added there is no "constitutional right to truthful information from officials during a public health crisis." The court then listed what the poisoned residents can do instead: file tort claims in state court, petition legislatures, or elect representatives who will better manage the public water system.
